The petitioner is apprehending his arrest in connection with Deoria P. S. Case No.36 of 2017, registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. The victim died in an unnatural circumstances i.e., by sustaining burn injury in her matrimonial house within four years of her marriage. There is allegation of demand of dowry and torture for the same and in the event of non-fulfillment, threat of solemnization of second marriage by the petitioner. After hearing the parties and considering the nature of allegation against the petitioner, I am not inclined to grant

Patna High Court Cr.Misc. No.49935 of 2018(3) dt.31-10-2018 2/2 anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused.
