The petitioner apprehends his arrest in Bhojpur(Ara) Mahila P.S. Case No.83 of 2019 registered under Sections 341, 323, 498A, 504, 506, 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.

At the outset of the argument, Mr. Bachan Jee Ojha, learned counsel for the petitioner submits that petitioner is the husband of the informant. Petitioner is working in a private firm in Mumbai and petitioner is ready to resolve the dispute between the husband and the wife.

The learned counsel for the informant submits that petitioner is ready to live with her husband or for one time settlement of the dispute.

No.84436 of 2019(3) dt.18-06-2020 2/2 Taking into consideration the facts aforesaid, the petitioner, above named, is directed to surrender before the court below within a period of four weeks from the date of receipt of the order and on such learned court below shall enlarge the petitioner on provisional bail for six months on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bhojpur(Ara) in connection with Bhojpur(Ara) Mahila P.S. Case No.83 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Thereafter, the learned court below shall take all efforts for resolution of the dispute between the husband and the wife and if the dispute between the husband and the wife is amicably resolved, the provisional bail granted to the petitioner shall be confirmed. If the dispute between the husband and the wife is not amicably resolved without the fault of the informant, learned court below shall pass order on the provisional bail of the petitioner in accordance with law immediately after lapse of six months.
