The petitioner seeks bail in a case registered for the offence under Sections 420, 467, 468, 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act and also Section 27 of the Arms Act. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 18.11.2019.

No.85286 of 2019(2) dt.20-01-2020 2/2 Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur in connection with Sakra P.S. Case No. 536 of 2019 corresponding to G.R. No. 2238 of 2019.
