Mr.Zainul Abedin ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-03-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is in custody in connection with Kudhani (Turki O.P.) P.S. Case No. 418 of 2018 corresponding to G.R. No. 2914 of 2018 for the offence under sections 394, 302 and 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner has been made accused in this case on the basis of confessional statement of co-accused Basant Kumar. Learned counsel submits that similarly circumstanced co-accused Sujit Sharma @ Sujit Kumar has been granted bail by a coordinate bench of this Court vide order dated 6.3.2019 in

Patna High Court CR. MISC. No.1769 of 2020(4) dt.20-03-2020 2/3 Cr. Misc. No. 78375 of 2018.

The petitioner is in custody since 3.9.2019.

In order to maintain consistency, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge IIIrd (West) Cum ACJM-III, Muzaffarpur, in connection with Kudhani (Turki O.P.) P.S. Case No. 418 of 2018 corresponding to G.R. No. 2914 of 2018, subject to the condition:

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. On release, the petitioner is required to tender his
