03-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Naugachiya P.S. Case No. 345 of 2019 registered for the offence under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case is that the petitioner alongwith two other co-accused, armed with pistol, made firing on the son of the informant, but it did not hit anybody. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case due to village politics. It is further submitted that as per F.I.R. itself, 15-20 rounds firing were made, but nobody got any injury, though it was a crowded place. Petitioner is having no criminal antecedent.

Ist, Naugachiya in connection with Naugachiya P.S. Case No. 345 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay U T
