Petitioner seeks bail in a case registered for the offences punishable under Sections 363,366(A) of the Indian Penal Code.
The FIR is specific that co-accused-Anil Mahto kidnapped to the minor daughter of the informant, aged about 15 years, with intent to marry with her. Petitioner is not named in the FIR. The impugned order would reveal that no substantial material has come against the petitioner during investigation. Prayer for bail has been refused mainly as the victim is still traceless. Considering the fact that there is no substantial material against the petitioner, let the petitioner,
Patna High Court Cr.Misc. No.51074 of 2018 (2) dt.31-08-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sadar Police Station Case No.348 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
