In this case, the petitioners are seeking anticipatory bail in connection with Kharik P.S. Case No. 150 of 2019/ POCSO- 72 of 2019, registered for the offence under Section 366(A)/34 of the Indian Penal Code and under Section 12 of the POCSO Act.

It has been alleged that the daughter of the informant was kidnapped by the petitioners for the purposes of marriage. However, the girl has appeared and stated that she was not kidnapped but, she had gone to his relative on account of some dispute with her parents and when she came to know

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1st, -cumSpecial Judge, POCSO Act, Bhagalpur, in connection with Kharik P.S. Case no.150 of 2019/ POCSO- 72 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioners for the purposes of investigation and interrogation, they will remain present for the investigation.
