In this case, the petitioners are seeking anticipatory bail in connection with Nath Nagar P.S. Case No.427 of 2019, registered for the offence punishable under Sections 366 (A), 323, 504, 506/34 of the Indian Penal Code and Section 8 of POCSO Act.

Allegation has been made that the co-accused including the petitioners have kidnapped the minor daughter of the informant for the purpose of marriage, however, counsel for the petitioners submits that they are family members of coaccused Kailash Yadav, who is said to be the main accused and

Patna High Court CR. MISC. No.5303 of 2020(2) dt.29-02-2020 2/2 the victim in her statement under Section 164 Cr.P.C. has stated that she was married with co-accused Kailash Yadav about three months ago on her own volition and nothing has been stated against these petitioner.

Looking to the entire facts and circumstances of the case, let the petitioners, above-named, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge-cum Special Judge, POCSO Act, Bhagalpur, in connection with Nath Nagar P.S.
