The petitioner seeks bail in Parbatta (Bharat Khand) P. S. Case No. 319 of 2019 , G.R. No.2429 of 2019 instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.

It is submitted by the petitioner's counsel that the petitioner is in custody since 16.08.2019. The allegation has been levelled against the petitioner by Bhabhi of the deceased. The petitioner, happens to be Gotani of Bhabhi, namely, Laxmi Devi, who has made accused on suspicion on the basis of love affair between the petitioner's brother and deceased, namely, Budhni Devi. The petitioner along with maternal uncle of Puja Devi and 2-3 unknown persons have been implicated merely on

Patna High Court CR. MISC. No.84623 of 2019(2) dt.19-12-2019 2/2 suspicion. None of the immediate relatives of the deceased have come forward to make any allegation against the petitioner. Being an innocent female, she bears no criminal antecedents. The learned APP for the State opposed the prayer for bail. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- 1st Khagaria, in connection with Parbatta (Bharat Khand) P. S. Case No. 319 of 2019 , G.R. No.2429 of 2019, subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if she fails to do so on two consecutive dates, her bail bond will be liable to be cancelled.
