The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 324, 325, 354, 379, 307, 447, 427, 504, 506 of the Indian Penal Code.
During course of assault there is no specific allegation against petitioner No.1, Pradeep Singh and petitioner No.3, Rohit Singh @ Rohit Kumar of commission of any injury to anyone. Though, there is specific allegation against petitioner No.2, Sujeet Singh and co-accused, Raja Babu to have caused injury to Navnit Singh and Govinda Singh. However, there is no
Patna High Court Cr.Misc. No.60442 of 2018(3) dt.05-11-2018 2/2 injury report in respect of the aforesaid person in the case diary. Though, injury report of other injured is there. There is case and counter case.
Considering the entire facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Sangrampur Police Station Case No.37 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
