This is an application for grant of anticipatory bail in connection with Susand P.S. Case No. 136 of 2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 427, 448, 354, 452, 380, 307 and 504 of the Indian Penal Code.
The allegation is regarding the accused persons having assaulted the informant and other family members of the prosecution side and thereafter, they are said to have snatched golden mangalsutra from the informant.
The learned counsel for the petitioner has submitted that the petitioner is having a clean antecedent, there is no allegation of specific overt act as against him and the fact is that allegation
Patna High Court CR. MISC. No.83624 of 2019(2) dt.17-12-2019 2/2 has been levelled on the co-accused person, namely, Raja Kumar Sah of having assaulted the informant by means of iron rod , causing swelling. It is further submitted that the petitioner has got no complicity in the matter and deserves to be granted the privilege of anticipatory bail.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/concerned court in connection with Sursand P.S. Case No. 136 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
