Petitioner seeks bail in a case registered for the offences punishable under Sections 115, 120B of the Indian Penal Code and Sections 25(1-b)A, 26, 35 of the Arms Act. From the bed of this petitioner, a country made loaded pistol was recovered and the petitioner along with coaccused Mukesh Kumar was apprehended at the spot. Submission is that the petitioner is in custody since 13.01.2018. Petitioner has got no criminal antecedent. In fact, the pistol was of relative Mukesh Kumar and petitioner has no knowledge about that.

Considering the aforesaid material, let the petitioner, above named, be released on bail on completion of

Patna High Court Cr.Misc. No.17831 of 2018 (2) dt.02-04-2018 2/2 nine months of custody if the trial is not concluded in the meantime on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kako Police Station Case No. 08 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
