JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Kadwa P.S. Case No. 53 of 2017 for the offence punishable under section 376 of the I.P.C. In the FIR against the petitioner there is allegation for committing rape upon the informant and further to threw fire bundles in the house but the statement of the victim has been recorded under section 164 of the Cr. P.C. wherein she has stated that there is dispute for the land of house and the petitioner has not committed rape and he has not done anything, vide Annexure-2 In the facts and circumstances stated above, considering the statement of the victim girl recorded under section

Patna High Court Cr.Misc. No.17309 of 2018 (2) dt.10-04-2018 2/2 164 of the Cr.P.C, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Katihar in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
