ANJANA MISHRA ORAL ORDER 20-01-2020 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.09.2019 in connection with Mansahi P.S. Case No.77 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but the petitioner has been named as he was the pillion rider of the motorcycle from which the alleged recoveries were made.

Considering the aforementioned facts and circumstances and that the petitioner is having no criminal antecedents, let the petitioner, above named, be released on
