Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 31.8.2017 passed in Cr. Misc. No.38310 of 2017 on merit. The petitioner has criminal antecedent.
Submission of the learned counsel for the petitioner is that six months period has expired and up till now the trial has not been concluded but he has fairly admitted that out of five witnesses four witnesses have been examined and the case is pending for examination of only one witness.
Heard learned A.P.P. also.
Having heard both sides and in such view of the matter, I am not inclined to grant bail to the petitioner, however,
Patna High Court Cr.Misc. No.24639 of 2018 (3) dt.02-05-2018 2/2 the learned trial court is directed to conclude the trial within a period on one month from the date of receipt of the order. It is also made clear that if the trial is not concluded within a period of one month and there is no laches on the part of the petitioner, he shall be released on bail in connection with Case No.C-II-124/2013 to the satisfaction of Additional Sessions Judge 2nd-cum-Special Judge Excise, Siwan.
With the aforesaid observation, this application is disposed of.
