The petitioner is in custody since 29.08.2019 in connection with Bihariganj P.S. Case No. 289 of 2019 for the offence registered under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that only on account of land dispute between the parties and due to dirty village politics, the petitioner has been named in the first information report. Admittedly, no one has seen the occurrence and it is only alleged that the petitioner was seen fleeing away from the place of occurrence which is rather improbable. Considering the aforesaid facts and circumstances of

Case No. 289 of 2019.
