The petitioner seeks regular bail in connection with Turkauliya (Banjariya) P.S. Case No. 340 of 2019 for the offence punishable under Sections 302, 34 of the Indian Penal Code.

The allegation is regarding the sister of the informant having been assaulted by her husband and other accused persons and subsequently, she is stated to have been strangulated to death by her husband.

The learned counsel for the petitioner submits that the petitioner is brother-in-law of the deceased victim lady and staying separately, hence has been falsely implicated in the

Patna High Court CR. MISC. No.83651 of 2019(3) dt.18-03-2020 2/2 present case and the fact is that if at all any person is having any complicity in the present case, it is the husband of the deceased victim lady, who is stated to be behind the bars. It is further submitted that the petitioner is having a clean antecedent and similarly situated co-accused persons have been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 11.12.2019 passed in Cr. Misc. No. 72539 of 2019. The petitioner is stated to be languishing in custody since 19.10.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya (Banjariya) P.S. Case No. 340 of 2019.
