The petitioners seek bail in anticipation of their arrest in connection with Manigachhi P.S. Case No. 25 of 2018 dated 07.02.2018 instituted for the offences under Sections 448, 341, 323, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.
For having filed a case under Sections 498A, 341, 323, 504 and 506/34 of the Indian Penal Code by the informant and wife of petitioner no. 3, the present occurrence is said to have taken place. The petitioner no. 1 is the cousin father-in-law of the daughter of the informant whereas the petitioners no. 2 and 3 are the father-in-law and husband of the daughter of the informant.
Patna High Court Cr.Misc. No.25293 of 2018(3) dt.03-05-2018 2/2 Earlier, the petitioners were made accused in connection with Manigachhi P.S. Case No. 10 of 2018, referred to above, which was lodged under Section 498A and other sections of the Indian Penal Code against the petitioners. The petitioners no. 1 and 2 have been made accused in this case because of their not having accepted the marriage of petitioner no. 3 with the daughter of the informant. That apart, there appears to be a matrimonial dispute between the parties. The injuries suffered by the victim of the present case are opined to be simple in nature.
Considering the background facts of this case, the petitioners above named are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Darbhanga in connection with Manigachhi P.S. Case No. 25 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
