1. Heard the parties.

2. The petitioner apprehends her arrest in connection with Chandauti P.S. Case No. 297 of 2025 dated 08.08.2025 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the first information report a total quantity of 30 liter of country made mahua wine has been recovered from a Hero splendor motorcycle bearing registration no. BR02BQ8542 and Police apprehended two co-accused namely, Motu Kumar Chaudhary and Sachin Kumar.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only because he happens to be the registered owner of the Hero Splendor motorcycle in question. In paragraph no. 9 of the bail

Patna High Court CR. MISC. No.90030 of 2025(2) dt.24-12-2025 2/2 application the petitioner has stated that the villager of the petitioner had borrowed her motorcycle for some necessary work and the petitioner had no knowledge that her motorcycle was being used for transportation of illicit liquor. The petitioner has no criminal antecedent.

Regard being had to the submission made by the parties, taking into consideration the justification given regarding recovery of country made mahua liquor from the motorcycle in question and the fact that the petitioner has no criminal antecedent, accordingly, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise-4, Gaya in connection with Chandauti P.S. Case No. 297 of 2025 subject to the condition as laid down under Section 482

(2) of the B.N.S.S. 2023.
