Petitioner seeks modification of the order dated 02.08.2017, passed in Cr. Misc. No. 30123 of 2017 in connection with Warisaliganj P.S. Case No. 14 of 2017, pending in the court of learned Additional Chief Judicial Magistrate-II, Nawada, whereby while granting bail to the petitioner one of the conditions was "that the petitioner will appear before the learned court below on each and every date and failure to appear before the learned court below on two consecutive dates without assigning any reason will entail cancellation of his bail bonds". It has been submitted by the learned counsel for the petitioner that the petitioner is a student and preparing for his

Patna High Court Cr.Misc. No.47230 of 2018(2) dt.08-08-2018 2/2 competitive exams, hence, it is very difficult for him to appear on each and every date before the learned court below and, as such, some relaxation be given.

The modification application is allowed to the extent that the petitioner will appear before the learned court below as and when required, failure of which will entail cancellation of his bail bonds.
