2. The petitioner has prayed for bail in connection with Kadamkuan P.S. Case No. 646 of 2025 registered for the offence punishable under Sections 61(2), 109, 111 and 140 of B.N.S.

3. The case of the prosecution, in short, is that certain unknown miscreants have caught the informant. They were armed with a weapon. When the informant raised alarm, one of them was apprehended who was identified as Saurav Kumar. Saurav Kumar has disclosed that this petitioner who is stepbrother has arranged the contract killer at Rs. 8,00,000/-.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.91379 of 2025(2) dt.28-01-2026 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. From perusal of the F.I.R. itself it is clear that only one person Saurav Kumar was apprehended and from his possession, only a mobile and bike was recovered whereas it is alleged that the miscreants were armed with weapon. It has further been submitted that the name of this petitioner has surfaced in the statement of the co-accused. It has also been submitted that there is enmity between the informant and the petitioner as he is stepbrother of the petitioner. No injury was sustained by the informant. It has also been submitted that this case has been filed after taking advice from advocate to implicate the petitioner with whom the informant is having enmity whereas no occurrence has taken place. Nothing has been recovered from the possession of this petitioner and the story of arranging the killers is all concocted. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 17.09.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

No.91379 of 2025(2) dt.28-01-2026 3/3 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class XIV, Patna in connection with Kadamkuan P.S. Case No.646 of 2025.
