The petitioners seek pre-arrest bail in connection with Hajipur Sadar P.S.Case No. 74 of 2018 registered under Sections 143, 144, 145, 186, 188, 323, 333, 353, 307, 379, 506 and 504 of the Indian Penal Code, 27 of the Arms Act and Sections 4/40(8)/18(D) of the Bihar Mines and Minerals Act. Considering the allegation made in the FIR that the petitioners and others were involved in illegal mining and transportation of sand and when the police arrived and tried to apprehend them, they attacked upon the police party causing

Patna High Court Cr.Misc. No.29810 of 2018 (2) dt.17-05-2018 2/2 injury to several persons and one Monu Rai, who was also a member of the unlawful assembly, also sustained injuries, I am not inclined to grant pre-arrest bail to the petitioners.
