JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This application, for grant of anticipatory bail, arises out of Mashrakh P.S. Case No. 309 of 2019, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30, 30(a)/38/41 of Bihar Prohibition and Excise Act.
Allegation is of recovery of 2200 litres of spirit from the co-accused, who named the petitioners as his associates. Submission of learned counsel for the petitioners is that they have no criminal antecedent and have falsely been implicated in this case on the confession of co-accused and except that there is nothing against the petitioners. Heard learned A.P.P. also.
