JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 1878 of 1998, corresponding to Trial No. 2242 of 2019, lodged for the offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code. As per complaint prosecution case is that petitioners who are police personnel, along with other police personnel gun down one Krishna Pratap Singh @ Anshu and petitioners are named in the FIR. Submission of learned counsel for the petitioners is that as a matter of fact on information of firing by veteran criminals police reached at the house of Madhusudan Singh where there was exchange of firing in which Krishna Pratap Singh @ Anshu received injuries and succumbed to the injuries for that Phulwaria P. S. Case No. 54 of 1998 was registered against the petitioners and others and
Patna High Court CR. MISC. No.83898 of 2019(2) dt.18-12-2019 2/2 considering the same main accused person, against whom there is allegation of firing, has been granted anticipatory bail by order dated 21.6.2019 passed in Cr.Misc.No. 21676 of 2019. Heard learned APP also.
In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Gopalganj, in connection with Complaint Case No. 1878 of 1998, corresponding to Trial No. 2242 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
