JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 18-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Ghoshi P.S.Case No. 244 of 2017 registered under Sections 147, 149, 323, 504, 506, 379 and 307 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that there is general and omnibus allegation against five accused persons in the FIR relating to assault on the husband of the informant out of whom co-accused Dablu Kumar and Bablu Kumar have already been granted pre-arrest bail by orders dated 05.04.2018 and 28.03.2018 passed in Cr.Misc. No. 18301 of 2018 and Cr.Misc. No. 5890 of 2018 respectively. It is further submitted

Patna High Court Cr.Misc. No.29820 of 2018 (2) dt.18-05-2018 2/2 that there is a counter case also which has been instituted on the basis of statement given by the mother of the co-accused Dablu Kumar.

Considering the submissions made above, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Ghoshi P.S.Case No. 244 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
