JUSTICE ARUN KUMAR ORAL ORDER 08-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Piro P.S.Case No. 107 of 2017 registered under Sections 302/120B/34 of the Indian penal Code and 27 of the Arms Act.

Allegation in brief is that suspicion is raised that Md. Mubarak Ansari, who is the ex-husband of the second wife of the informant's brother/deceased, along with this petitioner had killed his brother by firearm .

Submission is that informant is not an eye witness, he raised only suspicion against Md. Mubarak Ansari because his wife married with the deceased and Md. Mubarak has been admitted to bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 33121 of 2017 , so seeks bail on the ground of parity. Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.27838 of 2018(2) dt.08-05-2018 2/2 the petitioner, namely, Md. Jumrati Ansari, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Ara, Bhojpur in connection with Piro P.S. Case No. 107 of 2017.
