The petitioners seek bail in anticipation of their arrest in connection with Dharhara P.S. Case No. 31 of 2018 dated 17.02.2018 instituted for the offences under Sections 341, 323, 324, 379, 147, 148, 149, 504, 506, 307 of the Indian Penal Code.

The informant has alleged that he was made to stop his vehicle on the point of gun by co-accused Raushan; whereafter, he was divested of his belongings. Though the petitioners have been named in the F.I.R., but no specific allegation has been levelled against them. They are stated to be simply by-standers.

The petitioners do not have any criminal antecedent.

Patna High Court Cr.Misc. No.30223 of 2018(3) dt.28-06-2018 2/2 The learned counsel for the petitioners has submitted that there is a counter version of the occurrence vide Dharahara P.S. Case No. 33 of 2018 which has been registered under Sections 341, 323, 324, 504/34 of the I.P.C.

The entire dispute arose because of caste rivalry in the village in question.

Considering the aforesaid facts, the petitioners above named are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Munger in connection with Dharhara P.S. Case No. 31 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
