2. The instant writ application has been filed for the following relief(s):- "(i) 1. That this application is being filed for issuance of an appropriate writ(s), rule(s), order(s), direction(s), commanding upon the respondents to show cause as to why the encroachment has not been removed from the public land situated

Patna High Court CWJC No.44 of 2026(2) dt.25-06-2026 2/2 in front of the Raiyati land of the petitioner i.e. Khata No. 70, Khesara No. 448 villageGhordiha, Circle Kargahar, District- Rohtas And/Or Pass such any other order/orders which may found fit in the facts and circumstances of the case."

In light of Annexure P/2 and P/3, the Circle Officer, Kargahar, Rohtas will initiate the appropriate proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956 and, after giving notice to all concerned, necessary orders shall be passed, adjudicating the issues, in question, and once it is found that the land, in question, is a public land and the same has been encroached by the private persons, the same shall be made encroachment free within the three months from initiation of proceeding under Section 3 of the Bihar Public Land Encroachment Act, 1956

4. With the aforesaid observation and direction, the writ petition stands disposed of.
