The petitioner is apprehending his arrest in connection with Goraul P.S.Case No.90 of 2016 registered for offences punishable under Sections 414 of the Indian Penal Code and Section 11A of the Animal Cruelty Act.

Allegation against the petitioner as per FIR is that the petitioner was arrested while taking buffalows, caws etc. in the pick-up Van, however, at that time he was released on bail, later on a case under Section 414 of the IPC was also lodged against him.

Submission of the learned counsel for the petitioner is that the prayer for anticipatory bail was refused by the learned court

Patna High Court Cr.Misc. No.35021 of 2018 (3) dt.09-07-2018 2/2 below on the ground that he was on police bail. Heard learned A.P.P. also.

In view of the facts and circumstances, the petitioner was earlier released on police bail as such he has misused the privilege of the same, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail and the learned court trial will consider the aforesaid aspect of the matter and will dispose of the prayer for bail of the petitioner, if possible, on the same day.
