The petitioner is in custody since 15.11.2017 in connection with Bhargama P.S. Case No. 248 of 2017 registered for the offence under Sections 25(1-b)a and 26 of the Arms Act. Learned counsel for the petitioner submits that the alleged recovery was not made from conscious possession of the petitioner but from northern room of house which was being searched. It is further submitted that apart from the present case, the petitioner has been named in one other case on the basis of confession in which he has already been granted bail.
