2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 310(2) and 311 of B.N.S.

3. The case of the prosecution is that while the informant was going on his bike at 7:40 PM near Nadawan Bridge, six unknown miscreants overtook him, stopped him and attempted to snatch his bike and bag. When the informant objected, he was assaulted with the butt of the pistol on his head and the miscreants took away his bike and bag containing Rs. 16,000/-.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged

Patna High Court CR. MISC. No.89627 of 2025(2) dt.15-01-2026 2/2 against unknown miscreants. During investigation, one coaccused Kundan Kumar has given his confessional statement and in his confessional statement, he has named this petitioner. Nothing has been recovered from the possession of this petitioner. Save and except the confessional statement of co-accused Kundan, there is nothing against this petitioner. In this case, TIP has been conducted but learned counsel for the petitioner has submitted that he was not identified in TIP. Moreover, he is languishing in judicial custody since 20.09.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and has submitted that petitioner is having criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhanarua P.S. Case No. 563 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masurhi, Patna.
