JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Sheosagar (Baddi) P.S. Case No. 134 of 2017, dated 06.06.2017, instituted for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
While the informant was about to deposit money in the bank, two unknown miscreants took out Rs. 14,000/- from his back pocket. On chase, one Gobind Pasi was arrested, who disclosed the name of the petitioner as one of his associates.
Patna High Court Cr.Misc. No.33255 of 2018 (2) dt.04-07-2018 2/3 Learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. In fact, Gobind Pasi, one of the accused persons, is said to have been arrested on chase and from his possession there has been recovery of money, which had been pilfered. Since the informant had seen two persons together moving behind him, therefore, aforesaid Gobind Pasi was made to take name of any other person in order to make the allegations look genuine.
It has also been submitted that the petitioner does not have any criminal antecedent and he has got no concern with aforesaid Gobind Pasi.
Regard being had to the fact that nothing has been recovered from the possession of the petitioner and his name has transpired only on the confession of an arrested accused person, this Court is inclined to enlarge him on anticipatory bail.
Let the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sheosagar (Baddi) P.S. Case No.
