Petitioner, already in custody, seeks bail in connection with Amarpur P.S. Case No.560 of 2017 registered under Sections 120(B), 384, 420, 468, 471, 353, 388, 504 and 506 of the Indian Penal Code.
Allegation in brief is that the petitioner is not landless but got her name in the BPL list and his wife was also allotted Indira Awas Yojana and used to make demand of extortion from local officials by putting pressure on them by filing RTI. Learned counsel for the petitioner submits that the petitioner has falsely been implicated as he plays role of whistle blower by seeking information under RTI against the irregularities being done by the local officials, so has falsely
Patna High Court Cr.Misc. No.33706 of 2018(2) dt.25-06-2018 2/2 been implicated in this case and has been in custody since 20.02.2018.
Having considered the aforesaid facts and circumstances, petitioner Bihari Mishra is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Banka in connection with Amarpur PS Case No.560 of 2017.
