JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing lock-down on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and the learned counsel for the State.

The present writ petition has been filed to direct the respondents to transfer the petitioner on medical ground to a place where she may get proper medicines and environment as also to accommodate the petitioner according to her choice on account of her and her child health issues.

Patna High Court CWJC No.607 of 2020(3) dt.11-06-2020 2/3 The learned counsel for the petitioner has submitted, by referring to Annexure-12 to the present writ petition that by the order of the District Programme Officer (Establishment), Patna dated 16.03.2019, the petitioner has been posted on deputation basis at Dr. Bhim Rao Ambedkar Scheduled Caste +2 Residential School, Gaighat, Patna which is an appropriate posting for the petitioner, though on deputation basis, hence the authorities may be directed to sympathetically consider the prayer of the petitioner for continuing the aforesaid deputation at the aforesaid school at Gaighat, Patna.

Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with liberty to the petitioner to approach the respondent no. 3 i.e. the District Education Officer, Patna by filing appropriate representation within a period of six weeks from today and in case such a representation is filed, the District Education Officer, Patna shall dispose off the same within a period of six weeks thereafter.

It is needless to state that till the final disposal of the representation to be filed by the petitioner, as aforesaid, status quo existing as on today, shall be maintained, however, in case no representation is filed within a period of six weeks from

Patna High Court CWJC No.607 of 2020(3) dt.11-06-2020 3/3 today, the said order of status quo being granted in favour of the petitioner shall stand revoked automatically. The writ petition stands disposed off on the aforesaid terms.
