2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25 (1-A), 25 (1-AA), 25 (1-B)a, 26 (I) (ii) and 35 of the Arms Act.
3. The case of the prosecution is that there is recovery of various weapons including a country made pistol, live cartridges, iron rod, machines and equipment for manufacturing firearms were recovered from a hut belonging to Mittan Singh.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that at the time of raid, he was not apprehended and that his name was
Patna High Court CR. MISC. No.91023 of 2025(2) dt.30-01-2026 2/2 disclosed by the apprehended persons. It is further submitted that apprehended person, Md. Jehangir has been granted bail by a Bench of this Court vide order dated 02.04.2025 passed in Cr. Misc. No. 74510 of 2024. It is further submitted that the case of this petitioner stands on better footing. Moreover, the petitioner is languishing in judicial custody since 28.07.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has seven criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Muffasil P.S. Case No. 126 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger.
