Petitioner is in custody in connection with Turkauliya P.S. Case No. 229 of 2018 for the offence under sections 273, 273, 34 of the Indian Penal Code and Section 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner is in custody in connection with seizure of 70 liters of sprit.

Learned counsel for the petitioner submits that petitioner has no concern neither with sprit or motorcycle in which the alleged sprit was kept. He submits that petitioner has no criminal antecedent.

Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for two months, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Motihari, East Champaran, in connection with Turkauliya P.S. Case No. 229 of 2018.
