The petitioner has filed the instant application for grant of bail in a case registered for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2018 As per the allegation in the FIR, on a raid being conducted, 18 litres of country liquor and various articles for manufacture of liquor were recovered and the same are said to be belonging to the petitioner.
It is submitted by learned counsel for the petitioner that the alleged recovery has not taken place from the conscious possession of the petitioner and the petitioner has no concern either with the seized illicit liquor or with the articles for
Patna High Court CR. MISC. No.83857 of 2019(2) dt.17-12-2019 2/2 manufacture of liquor. It is further submitted that petitioner is in custody since 17.11.2019.
The application for bail has been opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the seizure narrated in the FIR together with the fact that the petitioner was accused in another criminal case under the Bihar Prohibition and Excise Act, the Court is not inclined to enlarge the petitioner on bail and as such his application for bail is rejected.
