The petitioner seeks regular bail in connection with Kudhani P.S.Case No.269 of 2018, registered for offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR, later on his name transpired on the confession during the investigation. It further appears that he is accused in four other cases, almost of similar nature.

Submission of the learned counsel for the petitioner is that except the confession there is nothing against him, he is in custody for almost 1 1⁄2 year. Charge sheet has already been submitted and there is no chance of tampering with the evidence.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd ACJM, West Muzaffarpur in connection with Kudhani P.S.case No.269 of 2018 with condition that he has to appear before the police station of his local area for a period of nine months in the second week of each month so that the police may watch his activities and conduct and if he is found actively involved in any serious nature of cases, prosecution is at liberty to move for cancellation of his bail bond.

Let a copy of this order be communicated to the S.P., Vaishali at Hajipur for the needful.

Accordingly, this application is allowed.
