2. The petitioners apprehend their arrest in connection with Bausi P.S. Case No.155 of 2025, registered for the offence under Sections 126(2), 115(2), 109, 303(2), 352, 3/5 of the BNS, 2023.

3. As per prosecution case, the informant gave fardbeyan before the police alleging therein that on 04/09/2025, at approximately 08:00 pm, the accused named in the FIR, armed with weapons, entered her courtyard, and began abusing her. They assaulted and injured the family members, bruising

In the mean time, the accused began pulling her daughter in-law namely Menka Devi and daughter Mamta Devi, by their hair, causing them to tear their clothes and become naked. The accused returned to the home and midnight and took Rs.50,000/- in cash, jewellery, groceries and valuables articles from a box and they threatened to kill all the injured persons, thereafter the accused persons fled away. Accordingly, the FIR.

Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence as alleged in the FIR and have falsely been implicated in this case, there is case and counter case between the parties. Learned counsel for the petitioners further submit that two criminal antecedents against the petitioners and in both the cases the petitioners are on bail, there is no specific allegation of assault on the petitioners. In such circumstances

5. The learned APP opposes the anticipatory bail application.

Considering the fact that although there are two criminal antecedents against the petitioners and in both the cases the petitioners are on bail, there is no specific allegation of assault on the petitioners. In such circumstances, I am inclined to grant the privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Araria in connection with Bausi P.S. Case No.155 of 2025, subject to the conditions laid down under Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita. (Alok Kumar Sinha, J) Prakash Narayan U T
