This application is for grant of regular bail in connection with Turkauliya (Banjariya) P.s.case No.717 of 2019 dated 16.10.2019 for the offences under Sections 363, 366A/34 of the Indian Penal Code.

Petitioner is not named in the FIR. There is allegation that on the point of Pistol, he along with the other accused persons kidnapped the minor daughter of the informant. Submission of the learned counsel for the petitioner is that as a matter of fact there was love affair between the victim girl and one Niraj Kumar and she fled away along with him but he has been falsely implicated in this case. He is in custody for five months.

Patna High Court CR. MISC. No.84429 of 2019(3) dt.24-02-2020 2/2 Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the girl is minor and she has still not been recovered..

Having heard both sides and considering the above, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner is at liberty to renew his prayer for bail once the girl is recovered and her statement under Section 164 Cr.P.C. is recorded.

With the aforesaid observation, this application is dismissed.
