2. The present writ petition has been filed to decide and disposed of the representation of the petitioner filed before the D.I.G., Champaran Range, Bettiah forwarded to the S.P. West Champaran, Bettiah vide letter No. 996 dated 17.05.2019. In crux, the petitioner has filed the writ petition for his promotion from the post of cook i.e., Class IV post to Class III post. On the basis of that with due permission from his officials, he has passed the intermediate exam and has fulfilled the criteria for such promotion.

3. Counsel for the petitioner submits that petitioner

Patna High Court CWJC No.3411 of 2020(2) dt.22-12-2023 2/2 has joined his service on the post of cook on 01.02.2001 in West Champaran, Bettiah. His representation is pending and he seeks direction from this Court that a decision may be taken on his representation.

4. Counsel for the State submits that counter-affidavit has been filed in which Annexure-B has been attached and it has been submitted that due to pendency of S.L.P.(C) No. 30621 of 2011, the promotion was pending, but at present, the situation has changed and decision on promotion shall be taken soon.

5. In this background, this writ petition stands disposed of directing the D.I.G., Champaran Range, Bettiah to consider the case of the petitioner within 90 days from the date of production of the order.
