Petitioner in this writ petition seeks direction to respondent no.5 to adjust the amount of Rs.5,65,000/- which has been spent in course of fencing boundary wall of J.R.S. College, Jamalpur as the petitioner has been working as Assistant Clerk in the aforesaid college and the then In-charge Principal of

College, Jamalpur (respondent no.6) was departmentally authorized to complete the work of fencing boundary wall and respondent no.6 issued time to time several cheques after filling the amount into the cheques. The petitioner after withdrawing the amount handed over the same to respondent no.6 but now the voucher of Rs.5,65,000/- has not been adjusted. From the facts, it appears that Dr. Devraj Suman, the In-charge Principal of J.R.S. College, Jamalpur wrote letter to the Tilkamanjhi Bhagalpur University, Bhalgalpur for construction of boundary wall but without sanction of the amount by the competent authority, the In-charge Principal and the Building Committee of the aforesaid college started constructing boundary wall from the fund of the college.

It is the case of the petitioner that he withdrew the amount on the basis of cheque issued by the In-charge Principal and handed over to the same to the In-charge Principal. There is no material on record to show that how much amount was withdrawn by the petitioner and what amount he handed over to the Principal. The In-charge Principal spent the amount for construction of the boundary wall without getting sanction from the competent authority.

Patna High Court CWJC No.1866 of 2020(2) dt.04-02-2020 3/3 by the petitioner.

Having considered the facts, I find no merit in this writ petition. Accordingly, the same is dismissed. (Prabhat Kumar Jha, J) Harish/- U
