In this case, the petitioner is seeking anticipatory bail in connection with Riga P.S. Case No.265 of 2018 registered for offence punishable under sections 341, 323, 366(A), 376, 120(B)/34 of the Indian Penal Code and sections 4, 6, 8 and 11 of the POCSO Act.

In the FIR, serious allegation has been made against the petitioner and other associates, out of them, four persons have been tried in Trial No.88 of 2019 in which the victim girl herself along with brother and sister appeared and stated that the criminal case has been lodged by her mother at the instance of some villagers who are inimical terms with them and after consideration of the statement made in the trial, four persons

Patna High Court CR. MISC. No.86064 of 2019(2) dt.20-02-2020 2/2 have been acquitted.

In such view of the matter, the petitioner in the event of arrest or surrender before the court below within six weeks from today, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge-cum- Special Judge, POCSO Act, Sitamarhi in connection with Riga P.S. Case No.265 of 2018, subject to the conditions as laid down under section 438 Cr. PC and also subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
