ANJANA MISHRA ORAL ORDER 20-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.11.2019 in connection with Piar P.S. Case No.111 of 2019 registered for the offence under Sections 272, 273 of the Indian Penal Code and Sections 30(A), 38/41 of the Bihar Prohibition and Excise Act, 2016.

Considering the fact that the alleged recoveries were not from the conscious possession of the petitioner but from his house and the same were made in his absence and also that he is not having any criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise,
