Petitioner, apprehends his arrest registered for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code.

Informant is the father of the victim who has stated that on 10.06.2019 his minor daughter Neha Kumari aged about 16 years, slept with other family members, however on next day on 11.07.2019 she was not found in the house and after much search he was informed that petitioner has enticed her away for the purpose of marriage.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. His minor daughter went to Punjab on her own volition and in

No.84464 of 2019(2) dt.19-12-2019 2/2 her statement made under Section 164 Cr.P.C. she has not named petitioner or has alleged any act against him and she solemnized marriage with the son of the petitioner. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on prearrest bail on furnishing bail bond of Rs. 20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge 6th-cum-A.C.J.M., Muzaffarpur, in connection with Mushahari P.S. Case No. 171 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
