This contempt petition has been filed for initiation of contempt proceeding against the contemnor Opposite Party for deliberately and willfully disobeying the order dated 29.01.2018 passed by this Court in CWJC No. 22353 of 2013. Petitioner has filed writ petition with a prayer for fixation of his pay scale as Rs. 535-765 in place of Rs. 400-540, which is the pay scale of Health Worker having matriculation
Patna High Court MJC No.3243 of 2018 dt.19-12-2018 2/3 qualification. Petitioner passed the Pravesika Examination from Bihar Hindi Vidyapeeth, Deoghar, which was recognized by the Govt. of Bihar as equivalent to matriculation and writ petition was allowed with a direction to opposite party no. 5 Civil Surgeon cum Chief Medical Officer, Patna, to consider and decide the representation within three months from the date of receipt of order passed by this Court.
A show cause has been filed on behalf of opposite party no. 5 Civil Surgeon cum Chief Medical Officer, Patna, in which he has stated that in compliance of order passed by this Court the pay scale of petitioner has been revised from 01.04.1986 in higher scale of Matriculate Health Worker and accordingly, after making necessary endorsement service-book of petitioner has been sent to the Office of Accountant General for revision of pension, fixation of salary and payment of arrears of difference of salary as contained in Annexure-A of show cause. A show cause has also been filed on behalf of Accountant General, Bihar, Patna Opposite Party No. 7, in which it has been stated that Deputy Superintendent of Sub Divisional Hospital, Barh, in compliance of order passed by this Court forwarded the papers fixing the pay vide no. 635 dated 24.10.2018 with advice to issue revised authority for pension and
Patna High Court MJC No.3243 of 2018 dt.19-12-2018 3/3 gratuity and accordingly, revised authority for pension and gratuity in the revised pay of Rs. 4900/- was issued vide P.P.O and G.P.O dated 14.11.2018 as contained in Annexure-B of show cause.
After going through the show cause filed on behalf of opposite parties this Court is satisfied that the order passed by this Court has been complied, as such there is no reason to keep the matter pending and accordingly, contempt petition is disposed of.
