JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gaighat P.S. Case No. 46 of 2017 registered for the offences punishable under Sections 465, 467, 468, 471 and 420 of the Indian Penal Code.
As per FIR there is allegation that on the basis of forged TET certificate some of the candidates have been appointed and one of the candidates, namely, Rupam Kumari has also been appointed during that period when petitioner was the Panchayat Secretary.
Submission of learned counsel for the petitioner is that he has already retired from service and Rupam Kumari has been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 22.8.2017 passed in Cr.Misc.No. 30470 of 2017.

In view of above facts and circumstances, let petitioner surrender within a period of three weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XVI, Muzaffarpur, in connection with Gaighat P.S. Case No. 46 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to appear before the I.O. and co-operate in the investigation.
