JUSTICE SUDHIR SINGH ORAL ORDER 11-10-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Kotwali P.S. case No.380 of 2016 registered under Sections 467, 468, 420, 406, 120B/34 of the Indian Penal Code, pending in the court of Chief Judicial Magistrate, Patna.
Earlier the bail application of the petitioner was rejected vide Annexure-1 series to the present application. Against the same, the petitioner had preferred an application before the Hon'ble Supreme Court for grant of bail. Said application was also rejected by the Hon'ble Supreme Court. A report was called for from the court below regarding the stage of the case. It has been reported that only
Patna High Court Cr.Misc. No.57223 of 2018(3) dt.11-10-2018 2/2 three prosecution witnesses are left to be examined in the present case and the trial is expected to be concluded within a period of three months.
Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of a copy of this order. The District Magistrate, Patna and the Senior Superintendent of Police, Patna are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.
Let this order be communicated to the District Magistrate, Patna and the Senior Superintendent of Police, Patna.
