JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kalyanpur P.S. Case No. 142 of 2018 for the offenses under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner and others is that they have assaulted the deceased with first and slap. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 30.5.2019.

Considering the fact that allegation of assault is by first and slap by the accused persons and there is no criminal antecedent against the petitioner, let the petitioner, above
