JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Matihani P.S. Case No. 101 of 2019, registered for offences punishable under Sections 25(1-b)a, 26 of the Arms Act. Allegation against the petitioner is of recovery of one country made pistol and one live cartridge and apart from that he is accused in large number of cases.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this at the instance of the petitioner and in fact nothing has been recovered in this case and so far criminal antecedent of the petitioner is concerned, it has been submitted that in five cases, he has been acquitted and in remaining cases, he is on bail. Further submission is that petitioenr has been in custody for eight months.

Having heard both sides, in view of the allegation, at this stage, I am not inclined to enlarge the petitioner on bail, however, the trial court is directed to expedite the trial and conclude the same within a period of six months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail.
